Welcome to I Rent Miami! These Terms and Conditions (“Terms”) govern your use of our platform and services, specifically for listing and renting rooms and matching roommates. By accessing or using I Rent Miami, you agree to comply with and be bound by these Terms.

## 1. Introduction

I Rent Miami provides an online platform that connects individuals seeking to list rooms with potential roommates. By using our platform, you agree to adhere to these Terms, along with our Privacy Policy.

## 2. Definitions

– **Platform:** The I Rent Miami website and mobile applications.

– **Lister:** The person or entity listing a room for rent on the Platform.

– **Roommate:** The person or entity seeking to rent a room and be matched with a Lister.

– **Room:** Any rental accommodation listed on the Platform intended to be shared with a roommate.

## 3. User Eligibility

Users must be at least 18 years old and capable of entering into legally binding contracts to use the Platform.

## 4. Account Registration

To list a room or seek a roommate, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

## 5. Listings

Listers must provide accurate and detailed information about their rooms. This includes descriptions, availability, pricing, and any applicable rules or restrictions. Listers are responsible for keeping their listings up to date.

## 6. Roommate Matching

– **Matching:** Roommates can be matched with Listers through the Platform. The Platform facilitates introductions and communications between potential roommates.

– **Agreements:** All agreements, including rental terms and roommate arrangements, are made directly between the Lister and the Roommate. I Rent Miami does not intervene in or facilitate these agreements.

## 7. Payments

– **Direct Payments:** All payments related to room rentals are made directly between the Lister and the Roommate. I Rent Miami does not process payments or handle financial transactions between Listers and Roommates.

– **Listing Fee:** I Rent Miami charges Listers a listing fee for each room listed on the Platform. The listing fee is non-refundable and must be paid according to the fee schedule provided on the Platform.

## 8. Cancellations and Refunds

– **Cancellations by Roommates:** Roommates may cancel a booking according to the cancellation policy specified in the listing. Refunds, if any, are subject to the terms agreed upon between the Lister and the Roommate.

– **Cancellations by Listers:** Listers may cancel a booking in exceptional circumstances. Any refunds or compensation to Roommates are at the Lister’s discretion.

– **I Rent Miami’s Role:** I Rent Miami is not responsible for processing refunds or handling cancellations. These matters are to be resolved directly between the Lister and the Roommate.

## 9. User Responsibilities

– **Listers:** Listers are responsible for ensuring that their rooms comply with all applicable laws and regulations. Listers must also ensure that their rooms are safe and fit for occupancy.

– **Roommates:** Roommates must use rooms responsibly and comply with any rules or restrictions set by the Listers. Roommates are responsible for any damages caused during their rental period.

## 10. Prohibited Activities

Users agree not to:

– Use the Platform for any illegal or unauthorized purpose.

– Post false, misleading, or defamatory content.

– Discriminate against or harass any other user.

– Engage in any activity that could harm the Platform or its users.

## 11. Liability and Disclaimers

I Rent Miami provides a platform for connecting Listers and Roommates but does not own, manage, or control any rooms listed on the Platform. We are not responsible for any issues that arise during a rental or roommate arrangement. Users agree to release I Rent Miami from any liability related to their use of the Platform, including but not limited to disputes between Listers and Roommates, property damage, and personal injury.

## 12. Indemnification

Users agree to indemnify and hold harmless I Rent Miami and its affiliates from any claims, damages, or expenses arising from their use of the Platform.

## 13. Modifications to Terms

I Rent Miami reserves the right to modify these Terms at any time. We will notify users of any significant changes. Continued use of the Platform constitutes acceptance of the revised Terms.

## 14. Governing Law

These Terms are governed by and construed in accordance with the laws of the state of Florida, without regard to its conflict of laws principles.
